Problem encoding for Brightsign 4K: bitrate exceeds CBR setting

i trying encode brightsign 4k player. specs demand 30-40mbps bitrate , h.265. in ame checked cbr , chose 35mbps. resulting files not play correctly.

 

i sent sample brightsign support advised:

"there various bitrate spikes above 40mpbs problem. please re-encode video , ensure bitrate spikes don't exceed 40mbps limit."

 

please advise how prevent ame exceeding 40mpbs bitrate.
